29 CFR 1910.147(c)(1): Energy control program. The employer did not establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative. On or about April 20, 2018, employees were installing the Red Wave Batch Feeder without locking out during assembly, set up, and testing. The employer did not establish and document procedures that clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of potentially hazardous energy. The employees performing servicing and maintenance functions were exposed to caught-in hazards. Abatement certification is required for this item in accordance with 29 CFR 1903.19(c).

29 CFR 1910.178(l)(4): An evaluation of each powered industrial truck operator's performance was not conducted at least once every 3 years. On or about April 20, 2018, the employer failed to ensure that each authorized forklift operator was competent to safely operate powered industrial vehicles. Forklift operators with expired licenses had not been retrained or evaluated. Employees were exposed to the hazards associated with unverified operators using powered industrial vehicles to load and unload materials in trucks and within the warehouse. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
