29 CFR 1910.178(l)(4)(ii)(A): 1910.178(l)(4)(ii)(A): Refresher training in relevant topics was not provided to operator(s) when the operator was observed operating the vehicle in an unsafe manner: Worksite located at 2951 Rock Creek Parkway, North Kansas City, Missouri- Employee had been allowed to drive and operate a rough terrain forklift in an unsafe manner in which the boom of the forklift was kept above the horizontal position while traveling. The elevated boom, along with the sloped terrain, caused the forklift to turn over and nearly cost the lives of three employees.

29 CFR 1910.178(l)(4)(ii)(E): A condition in the workplace changes in a manner that could affect safe operation of the truck: Worksite located at 2951 Rock Creek Parkway, North Kansas City, Missouri- Three employees were nearly killed when the rough terrain forklift was driven on an embankment with the boom elevated and caused the forklift to roll over on top of an aerial two employees were working to set windows.
