OSH ACT of 1970 Section (5)(a)(1): Each employer shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm, in that employees were exposed to struck-by hazards: On or about April 19, 2018 Location: 8th Floor hoist landing A) A hoist car was operational while employees were constructing and installing required barrier protection to the sides and above the gates at each floor level. An employee that was tasked to construct and install that protection was struck by the hoist car on the eighth floor when it was being brought down from the ninth floor. Among other methods, feasible and acceptable abatement methods to correct this hazard include: 1. Follow the requirements of American National Standard Institute ANSI/ASSE A10.44-2014, "Control of Energy Sources(Lockout/Tagout) for Construction and Demolition Operations" while employees are in areas adjacent to the hoist that are not fully guarded. 2. Follow the requirements of American National Standard Institute ANSI A10.4-1963, "Safety Requirements for Workmen's Hoists" for guarding of hoist landing areas. 3. Follow the manufacturer's Operation Manual SHE Series 98030718 Rev. 05 Section 2.3.2, "Do Not Stand or Work Beneath the Car" 4. Do not allow employees to operate the construction hoist at or above a landing area that has not been fully protected. 5. Do not allow any employees on any landing area that is not fully protected while the construction hoist is in operation.
