On or about April 23, 2018, the employer did not institute an effective hearing conservation program for employees exposed to an 8-hour time-weighted average (TWA) of 85 dBA or greater. Employee(s), working in and near a paint booth with a ventilation system, was exposed to an 8-hour TWA sound level of 86.6 dBA.

29 CFR 1910.107(b)(9): Spray booths were not so installed that all portions were readily accessible for cleaning. A clear space of not less than 3 feet on all sides were not kept free from storage or combustible construction. On or about April 24, 2018 at the spray booth side of the shop, the employer did not ensure that a clear space on all sides of the spray booth existed. In addition these obstructions consisted of flammable material.

29 CFR 1910.134(h)(2)(i): Respirators were not stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals: On or about April 23, 2018, the employer allowed employees to store their respiratory protection in places that did not prevent potential damage to the respirator. The respirators were stored on a shelving unit with various chemicals such as thinners and lacquers. Chemical residues and dust were on the surfaces of the shelves the respirators were stored.
