29 CFR 1910.1200(f)(6)(ii): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals:  a. On or about April 24, 2018, within Research Laboratory's D121 and D124, secondary containers of hazardous chemicals, such as, but not limited to Acetone, Ethyl Alcohol (Ethanol), and Xylene were not properly labeled and exposed employees to injuries ranging from minor skin/eye irritation to permanent disability or death.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a. On or about April 18, 2018, within the Warehouse, the employer allowed employees to operate powered industrial trucks within the warehouse areas, without first ensuring that these employees were competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l), thereby exposing the operators, and other employees working in the area, to struck-by and crushing hazards.  The U.S. Department of Veterans Affairs, Veterans Health Administration, was previously cited for a violation of this occupational safety and health standard, or its equivalent standard 29 CFR 1910.178(l)(1)(ii), which was contained in OSHA inspection number 1238638, citation number 1, item number 1, and was affirmed as a final order on September 7, 2017, with respect to a workplace located at One Veterans Drive, Minneapolis, MN 55417.  The U.S. Department of Veterans Affairs, Veterans Health Administration, was previously cited for a violation of this occupational safety and health standard, or its equivalent standard 29 CFR 1910.178(l)(1)(i), which was contained in OSHA inspection number 1167347, citation number 2, item number 2, and was affirmed as a final order on January 12, 2017, with respect to a workplace located at 11201 Benton Street, Loma Linda, CA 92357.

29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed:  a. On or about April 26, 2018, within the Boiler Plant, the employer had not conducted periodic inspections on any other thirteen (13) energy control procedures used to lockout and or tagout machines and or equipment, thereby exposing employees to electrical shock and burn hazards.

On or about April 15, 2018, within the Warehouse, the employer allowed an employee to operate powered industrial trucks within the warehouse areas, without first ensuring that this employee had a current powered industrial truck (PIT) evaluation and was competent to operate a powered industrial truck safely, as demonstrated by the successful completion an evaluation, thereby exposing the himself and other employees working in the area, to struck-by and crushing hazards.
