29 CFR 1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee on a scaffold more than 10 feet (3.1 m) above a lower level was not protected from falling to that lower level by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section: On or about April 17, 2018, at the Tru by Hilton located at 1220 West Prien Lake Road in Lake Charles, LA, the employer did not ensure that employees using a Caterpillar TL1255C Telehandler equipped with a man basket to paint a design on the building were protected from falling approximately 35 by a complete guardrail system or safety harnesses which were tied-off to the basket. The guardrail system was incomplete as the front of the basket was not equipped with a top rail or mid-rail.
