29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  On or about April 17, 2018 the employer failed to establish and utilize a LO/TO program for employees and equipment at the facility. Employees operate equipment including but not limited to presses, cutting machines, laminators, and compressors. Hazardous energy sources include but are not limited to pneumatic, electrical, and mechanical. Employees are tasked with operating, servicing, setting up, and maintenance of the equipment.

29 CFR 1910.212(a)(1):  Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.  On or about April 10, 2018 the employer failed to ensure that effective machine guarding was in place on the Atom 25 ton hydraulic travelling head die cutting press, model G888. Employees operate the press by actuating a manual override switch on the bottom right panel of the operator side. The two hand controls equipped on the machine were not functional and in need of repair. No other guarding was in place on the equipment to protect employees.

29 CFR 1904.4(a): The employer did not record on the OSHA Form 300 or equivalent each work-related fatality, injury, or illness case that resulted in the general recording criteria:   On or about April 17, 2018 the employer failed to record and maintain OSHA injury logs at the facility. A work related injury occurred at the facility on April 10, 2018. This injury was not recorded on OSHA form 300 or an equivalent form. Additionally, the company did not maintain OSHA injury logs for previous calendar years.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  On or about April 17, 2018 the employer did not have a written hazard communication program in place at the facility. Employees are tasked with the handling and use of chemicals in the workplace. Hazardous chemicals include but are not limited to glues and solvents.
