29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  Employees at the construction site were exposed to struck by hazards in that the operator of the fork truck was allowed to operate the equipment with out first receiving a combination of formal and practical training.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  Employees engaged in construction cleanup activities were exposed to a fall hazards of approximately 20 feet from an elevated balcony to the ground below in that fall protection was not provided and used while accessing the balcony to load a forklift with trash.
