OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:  The employer is failing to protect employees from crushing and amputation hazards relating to the use of the Schwing Concrete Pump Truck System.  This condition was most recently observed at the job site located at: Jaxson Estates, Tennis Court, Lot 284, Wentzville, MO 63390, on or about April 23, 2018.  At this job site, the operator opened the grate (guard), exposing himself to the rotating agitator to clean out the hopper while the concrete pump motor was on.  While the operator was cleaning out the hopper, he fell inside the hopper, resulting in a fatal accident.    One method of abatement is to follow manufacturer instructions for clean out procedures.      Follow equipment inspection procedures as outlined in the American Society of Mechanic Engineers (ASME) B30-27-2014, paragraphs: Frequent Inspections, 27-2.1.2.1 and Periodic Inspections, 27-2.1.3.1     Follow clean out instructions in accordance with the America Concrete Pumping Association (ACPA), Safety Manual, General Rules, 1.17 and 1.18   a) The employer is not limited to the abatement methods(s) suggested by OSHA.  b) The employer is responsible for selecting and implementing an effective abatement method.

29 CFR 1910.304(g)(5): The path to ground from circuits, equipment, and enclosures was not permanent, continuous, and effective:    The employer is failing to protect employees from electrical hazards.  This condition was most recently observed at the job site located at: 200 College Campus Drive, Moscow Mills, 63362, on or about 5/17/2018, Employees in the maintenance shop were using a Dayton 30 inch floor fan attached to a yellow extension cord with missing ground prongs.

This condition was most recently observed at the site located at: Jaxson Estates, Tennis Court, Lot 284, Wentzville, MO 63390, on or about 4/23/2018.  The employer failed to recognize the need for a competent person to inspect their employees at the job sites and ensure the workers were performing their duties safely.

This was most recently observed at a job site located at: Jaxson Estates, Tennis Court, Lot 284, Wentzville, MO 63390, on or about 4/23/2018.  Employees who operate the Schwing Concrete Pump Truck were not trained to recognize crushing and amputation hazards associated with unguarded equipment during cleanout procedures.
