29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval. On or about June 20, 2018, the employer was using a Linde red forklift with a lifting beam forklift adapter and a battery lifting beam spreader bar as free rigging without the manufacturer's prior written approval that affected the capacity and safe operation of the forklift. This condition exposed employees to caught-in between and struck by hazards.

29 CFR 1910.179(e)(6)(i): Exposed moving parts such as gears, set screws, projecting keys, chains, chain sprockets, and reciprocating components which might constitute a hazard under normal operating conditions shall be guarded. On or about June 20, 2018 employees were using a battery spread bar where pinch points between sliding metal hooks and flat toothed bar at both ends for the bar were not guarded. This condition exposed employees to caught-in between hazards.
