OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee were working in the swing radius of heavy equipment, exposing workers to struck-by and crush-by hazards. (a) Job Site on or about April 19, 2018 and at times prior to, employees were allowed to enter the swing radius of a Hitachi Forester crawler knuckle boom ( Model ZX210F-3) with a fix heel grappler attachment, thus exposing employees to struck-by and crushing hazards.
