29 CFR 1910.23(c)(11): Portable ladders used to gain access to an upper landing surface did not have side rails that extended at least 3 feet (0.9 m) above the upper landing surface: a) On or about April 25, 2018, and at times prior, employees were exposed to fall hazards due to portable ladders not having side rails extending at least 3 feet above the upper landing surface. Employees used an aluminum portable ladder to access the roof of the front porch while painting trim at 6682 Phantom Way, Colorado Springs CO 80925. While using the ladder to access the upper landing, the side rails of the ladder were approximately 12 inches above the upper level. Abatement Note: Abatement certification is required for this item (see enclosed Certification of Corrective Action Worksheet).

29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2m) or more above a lower level was protected from falling by guardrail systems, safety net system, or personal fall arrest system: a) On or about April 25, 2018, and at times prior, employees were exposed to fall hazards due working on surfaces greater than 4 feet above a lower level without an adequate fall prevention system. Employees stood on the roof of the front porch to paint window trim at 6682 Phantom Way, Colorado Springs CO 80925. Employees were not provided a fall prevention system while painting trim. Abatement Note: Abatement certification is required for this item (see enclosed Certification of Corrective Action Worksheet).
