29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  On or about the 60 day period of March 5 - May 2, 2018, there were no frequent and regular inspections being performed by a competent person in that three employees were working on a corroded metal roof deck that had sustained years of water damage; visible corrosion and cracking metal underneath metal decking observed by the employer during roof inspection; stepladder in closed position, leaned against wall, and being used to access upper roof landing surface; extension ladder did not extend 3 feet above upper landing surface and had frayed rope used for ladder pulley system; and warning lines on roof were not flagged at 6 foot intervals.

29 CFR 1926.501(a)(2): The employer shall determine if the walking/working surfaces on which its employees are to work have the strength and structural integrity to support employees safely. Employees shall be allowed to work on those surfaces only when the surfaces have the requisite strength and structural integrity.  On April 30, 2018, located on the south end of a low-slope commercial roof, employees were working on a partially removed roof section where the underside of the metal roof decking was damaged and corroded. Potential fall heights were determined to be greater than 18 feet above the lower level below. The employer had not determined that the surface could safely support employees resulting in one employee falling through the damaged roof section.

29 CFR 1926.501(b)(2)(ii): Each employee on a walking/working surface 6 feet (1.8 m) or more above a lower level where leading edges are under construction, but who is not engaged in the leading edge work, shall be protected from falling by a guardrail system, safety net system, or personal fall arrest system. If a guardrail system is chosen to provide the fall protection, and a controlled access zone has already been established for leading edge work, the control line may be used in lieu of a guardrail along the edge that parallels the leading edge.  On April 30, 2018, located on the south end of a low-slope commercial roof, an employee was working on a damaged roof while not utilizing a fall protection system. Potential fall heights were determined to be greater than 18 feet above the lower level below.

29 CFR 1926.502(f)(2)(i): The rope, wire, or chain shall be flagged at not more than 6-foot (1.8 m) intervals with high-visibility material;  (a) On April 30, 2018, located on the south end of a low-slope commercial roof, employees were performing work in a roof work area encircled by a rope warning line that was erected without high visibility flagging.    (b) On May 2, 2018, located on the south end of a low-slope commercial roof, employees were performing work in a roof work area encircled by a rope warning line that was erected without high visibility flagging.

29 CFR 1926.1053(b)(4): Ladders shall be used only for the purpose for which they were designed.  (a) On April 30, 2018, located on the south end of a low-slope commercial roof, employees were using a 10 foot stepladder for roof access that was leaned against an exterior wall in the closed position. The ladder was not designed to be used in this manner per manufacturer specifications.   (b)  On May 2, 2018, located on the south end of a commercial roof, employees were using a 10 foot stepladder for roof access that was leaned against an exterior wall in the closed position. The ladder was not designed to be used in this manner per manufacturer specifications.

29 CFR 1904.40(a): Basic requirement. When an authorized government representative asks for the records you keep under Part 1904, you must provide copies of the records within four (4) business hours.  On May 2, 2018 and May 25, 2018, recordkeeping forms were requested from the employer. The employer was unable to provide any OSHA recordkeeping forms.
