29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system. a) On 2nd floor Parking Deck at 1270 Spring Street, Atlanta - On or about 4/26/2018, the employer exposed employees to fall hazards of 9 feet and 6 inches (9' 6") in that a fall protection system was not provided to employees cutting a 63" x 63" CMU wall on the second floor parking level. b) On 2nd floor Parking Deck at 1270 Spring Street, Atlanta - On or about 4/26/2018, the employer exposed employees to fall hazards of 9 feet and 6 inches (9' 6") in that a fall protection system was not provided to employees removing debris and walking near the opening of a 63" x 63" CMU wall on the second floor parking level.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: a) On 2nd floor Parking Deck at 1270 Spring Street, Atlanta - On or about 4/26/2018, the employer exposed employees to fall hazards of 9 feet and 6 inches (9' 6") in that employees were not provided training and information for fall protection when they were cutting concrete wall (CMU wall) approximately 63"x 63" and working near wall opening with approximately 9 feet and 6 inches height on the second floor, level P2 parking deck.
