29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder: a) On or about 05/01/18, in a trench/excavation located on West Ferry Street at Massachusetts Avenue, Buffalo,NY : Three employees were working in a trench/excavation that was 7 ft. 4 in. deep. The bottom half of a Werner extension ladder was placed in the trench at the northwest corner, and the employees used this ladder to access and exit the trench. The siderails of the ladder were only 10 inches above the top of the trench, and could not be extended higher because of the length of the ladder. The ladder was not secured at the top, and a grasping device such as a grabrail was not provided to assist employees in mounting and dismounting the ladder. NO ABATEMENT CERTIFICATION REQUIRED
