29 CFR 1910.27(b)(2)(i): The employer did not use a rope descent system was not used for heights greater than 300 feet (91 m) above grade unless the employer demonstrates that it is not feasible to access such heights by any other means or that those means pose a greater hazard than using a rope descent system:  On or about May 3, 2018, and times prior thereto, employees were exposed to fall hazards, while power washing windows from a rope descent system without the employer evaluating and providing and/or alternative for the height of the building which was over 300 feet.

29 CFR 1910.27(b)(2)(iv):  The employer did not ensure the rope descent system was inspected at the start of each workshift that it was to be used.  The employer did not ensure damaged or defective equipment was removed from service immediately and replaced:  On or about May 3, 2018, and at times prior thereto, employees were exposed to fall hazards, while using an unfit SkyGenie and job-made rope descent chairs that were found to be unfit and were not immediately removed and replaced such as those created by wear or deterioration:  a) South side, descent area: On or about May 3, 2018, and at times prior thereto, employees were exposed to a fall hazards from Sky Genie which descent chair showed evidence of chipping/broken and excessive wear.  b) South side, descent area: On or about May 3, 2018, and at times prior thereto, employees were exposed to a fall hazards from descent chair which had illegible markings, missing labels and excessive soiling such as mold and screws embedded into the descent chair to hold carpet on seating area in place.     c) South side, descent area: On or about May 3, 2018 and at times prior thereto, employees were exposed to  fall hazards when shock absorbed lanyard utilized was wrapped around with black electrical tape which may keep it from deploying.   d) South side, descent area: On or about May 3, 2018 and at times prior thereto, employees were exposed to fall hazards when utilizing Singing rock waist belt being utilized showed evidence of rust at the buckles, D ring and hook.

29 CFR 1910.27(b)(2)(v):  The employer did not use a rope descent system which had proper rigging, including anchorages and tiebacks, with particular emphasis on providing tiebacks when counterweights, cornice hooks, or similar non-permanent anchorages are used:  On or about May 3, 2018, and at times prior to employees were exposed to fall hazards while anchoring to building structures such as but not limited to red irons, HVAC generator structure, metal beams, vent pipes prior to them descending to cleaning high rise windows at various heights.
