OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a potential fall hazard of twenty-two (22) feet from a roof to ground level.  a) Roof, 65 Broadway Street, Milton, PA - Employees worked on the steep-sloped (14:12 pitch) roof of a commercial establishment and used a Climbing Technology Quick'Up Plus Rope Ascender as part of a personal fall arrest system which was not being used in accordance with the manufacturer's instructions and industry standards exposing the employees to a twenty-two (22) foot fall hazard, on or about May 3, 2018.  In accordance with 29 CFR 1903.19, abatement documentation and certification is required for this violation.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems.  a) 65 Broadway Street, Milton, PA - Employees worked on the steep-sloped (14:12 pitch) roof of a commercial establishment without any means of fall protection and were exposed to a twenty-two (22) foot fall hazard, as observed on or about May 3, 2018.  In accordance with 29 CFR 1903.19, abatement certification and documentation is required for this violation.  Tlatenchi Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1247223, citation number 1, item number 1a and was affirmed as a final order on December 5, 2017, with respect to a workplace located at 874 Schechter Drive, Highland Park, Wilkes-Barre, PA.

In accordance with 29 CFR 1903.19, abatement certification and documentation is required for this violation.  Tlatenchi Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1247223, citation number 1, item number 2f and was affirmed as a final order on December 5, 2017, with respect to a workplace located at 874 Schechter Drive, Highland Park, Wilkes-Barre, PA.

In accordance with 29 CFR 1903.19, abatement certification and documentation is required for this violation. 29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  a) East Roof Edge, 65 Broadway Street, Milton, PA - Employees used a Werner 28-foot aluminum extension ladder for roof access/egress with side rails that extended twenty (20) inches above the top of the roof edge exposing the employees to a twenty-two (22) foot fall hazard, as observed on or about May 3, 2018.  b) South Roof Edge, 65 Broadway Street, Milton, PA - Employees used a Werner 28-foot aluminum extension ladder for roof access/egress with side rails that extended eight (8) inches above the top of the roof edge exposing the employees to a twenty-two (22) foot fall hazard, as observed on or about May 3, 2018.  In accordance with 1903.19, abatement documentation and certification required for this violation.  Tlatenchi Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1250898, citation number 1, item number 3 and was affirmed as a final order on November 21, 2017, with respect to a workplace located at 5778 Bartell Road, Brewerton, New York.
