29 CFR 1910.120(q)(1): Employers who will evacuate their employees from the danger area when an emergency occurs, and who do not permit any of their employees to assist in handling the emergency, had not provided an emergency action plan in accordance with 29 CFR 1910.38: On or about May 4, 2017, the employer did not provide training in accordance to 1910.38(f)(3) when the emergency action plan changed. The company had a hydrochloric acid spill in 2016 that resulted in a corrective action of an alarm being installed in the pulpit. This alarm is manually activated and produces a series of 5 short whistle blasts alerting employees to evacuate. Employees had not been provided training to include how to differentiate the alarms in the area for fire evacuation versus spill evacuation.

29 CFR 1904.7(a): The employer did not record workplace injuries and illnesses that would be considered to meet the general recording criteria, and therefore to be recordable, if it results in any of the following: death, days away from work, restricted work or transfer to another job, medical treatment beyond first aid, or loss of consciousness: On May 4, 2018, the employer did not record the workplace injury/illness of an employee that resulted in work restriction and medical treatment beyond first aid caused by an incidental hydrochloric acid release on the evening of November 21, 2017 into the following day of November 22, 2017.
