On or about May 4, 2018, the employer did not determine the structural integrity of a walking/working surface used by an employee to access an elevator shaft.  This exposed the employee to a fall greater than six (6) feet to a level below.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  On or about May 4, 2018, the employer did not ensure fall protection was provided to an employee walking/working in an elevator shaft from a surface with unprotected sides and edges.  This exposed the employee to a fall greater than six (6) feet to a level below.

On or about May 4, 2018, the employer did not provide fall protection training to an employee who was permitted to work over an open elevator shaft from a walking/working surface with unprotected sides and edges, and without a fall protection system.  This exposed the employee to a fall greater than six (6) feet to a level below.

29 CFR 1926.1203(a): Before it begins work at a worksite, the employer did not ensure a competent person identified all confined spaces in which one or more of the employees it directs may work, and identified each space that is a permit space, through consideration and evaluation of the elements of that space, including testing as necessary.  On or about May 4, 2018, the employer did not ensure a competent person evaluated the workplace to determine if the elevator shaft where an employee was working was a confined space.  This exposed the employee to hazardous conditions such as, but not limited to, walking/working surfaces and fall protection.
