29 CFR 1926.451(f)(6): The clearance between scaffolds and power lines shall be as follows: Scaffolds shall not be erected, used, dismantled, altered, or moved such that they or any conductive material handled on them might come closer to exposed and energized power lines.  a) Front and side of house- Employees were working on a scaffold and a ladder that was less than two feet away from energized power lines; on or about 5/7/18.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.  a) Front of house-  Employees were exposed to a fall of approximately 16 ft while working on a pump jack scaffold without any fall protection; on or about 5/7/18.

29 CFR 1926.1053(b)(8): Ladders placed in a location where they could be displaced by workplace activities or traffic, such as in passageways, doorways, or driveways, were not secured to prevent accidental displacement, nor was a barricade used to keep the activities or traffic away from the ladder.  a) On the side of the house-  Employees were using a ladder that could be displaced by workplace activities and was not secured to prevent accidental displacement;  on or about 5/17/18.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) Side of the house- Employees were accessing a ladder that did not extend 3 feet above the platform of the scaffold; on or about 5/9/18.  Nicholas Home Improvement, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1), which was contained in OSHA inspection number 1108987, citation number 1, item number 3, and was affirmed as a final order on 11/08/16 with respect to a workplace located at 417 Fairmount Ave., Jersey City, NJ 07304.
