29 CFR 1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration:; Such activities were not performed only by experienced and trained employees selected for such work by the competent person.   a. On or about April 10, 2018, at the above addressed jobsite, employees performing masonry operations from a tubular welded frame scaffold, approximately five (5) tiers above the ground, were exposed to injuries from falls due to employees altering and dismantling the scaffold, who were not trained, experienced or competent in scaffold dismantling or alteration.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.   a.  On or about April 10, 2018, at the above addressed jobsite, employees conducting tuck pointing operations from a welded tubular scaffold were not trained to recognize the hazards associated with scaffolding.  The employees were thereby exposed to the hazards associated with falls.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms before being released for use by employees other than erection/dismantling crews:  a.  On or about April 10, 2018, at the above addressed jobsite, employees conducting masonry operations from a welded tubular scaffold, approximately five (5) tiers above the ground, were exposed to fall hazards due to the lack of a complete guardrail system.

29 CFR 1926.451(g)(4)(xv): Crossbracing used in place of a mid-rail was unacceptable because the crossing point of two braces is between 20 inches (0.5 m) and 30 inches ((0.8 M) above the work platform or as a top-rail when the crossing point of two braces is not between 20 inches (0.5 m) and 30 inches (0.8 m) above the work platform or as a top-rail when the crossing point of two braces is between 38 inches (0.97 m) and 48 inches (1.3 m) above the work platform.  The endpoints at each upright were more than 48 inches (1.3 m) apart.  a.  On or about April 10, 2018, at the above addressed jobsite, employees conducting masonry operations from a tubular welded framed scaffold, approximately five (5) tiers above the ground, that was not provided with a mid-rail, thereby exposing the employees to falls.
