29 CFR 1910.22(a)(1): All places of employment, passageways, storerooms, service rooms, and walking-working surfaces were not kept in a clean, orderly, and sanitary condition: (a) Stockroom- On or about May 8, 2018, and at times prior, the employer exposed employees to a health hazard, in that the stockroom was not maintained in a sanitary condition. The stockroom floor was full of rodent droppings and the area had a strong urine odor. (b) Office/Break Area- On or about May 8, 2018, and at times prior, the employer exposed employees to a health hazard, in that the office/break area was not maintained in a sanitary condition. Rodent droppings were observed where the employees store, warm up and eat food.

29 CFR 1910.141(a)(5): A continuing and effective extermination program was not instituted where rodents, insects, or other vermin were detected: (a) Family Dollar #1788- On or about May 8, 2018, and at times prior, the employer exposed employees to a health hazard, in that an effective extermination program was not maintained. The employer had not acted on all of the recommendations made by the exterminator, including, but not limited to, decluttering the stockroom to allow for a better inspection of the area and the removal of insulation used for rodent nesting at the stockroom back wall and store roof level.
