29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: On or about November 21, 2017, Units 7 thru 11, Atlanta, Georgia, sub-contractor employees setting up a pump jack scaffold approximately 35-foot tall contacted an overhead power line. The employer did not instruct the sub-contractor that the power lines were energized so that the sub-contractor would understand and minimize the hazards of working in the proximity of energized overhead power lines.

29 CFR 1926.416(a)(1): Employees were permitted to work in proximity to electric power circuits and were not protected against electric shock by de-energizing and grounding the circuits or effectively guarding the circuits by insulation or other means. On or about November 21, 2017, Units 7 thru 11, Atlanta, Georgia, effective precautions were not taken to protect sub-contractor employees from the hazards posed by an energized power lines in the vicinity where work was being done. Employees erecting the pump jack scaffolding were exposed to an electrical hazards when a section of the scaffold contacted the 11 kV power lines.

29 CFR 1926.416(a)(3): Before work began, the employer did not ascertain by inquiry, direct observation, or by instruments, whether any part of an energized electric power circuit, exposed or concealed, was so located that the performance of the work could bring any person, tool, or machine into physical or electrical contact with the electric power circuit. On or about November 21, 2017, Units 7 thru 11, Atlanta, Georgia, two sub-contracted employees setting up a pump jack scaffold for the installation of siding prior to the start of work, the employer did not effectively protect the employees from the electrical hazards by preforming a hazard assessment of the area.
