29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc. On or about May 1, 2018, employees operating the Cleveland Crane & Engineering 8D-10 Shear S/N MO-9355 located in the main building were exposed to pinch points created by the part hold downs and the point of operation as the guards did not prevent access to the danger areas.

29 CFR 1910.217(c)(2)(i): Every point of operation guard shall meet the following design, construction, application, and adjustment requirements: It shall prevent entry of hands or fingers into the point of operation by reaching through over, under or around the guard; It shall conform to the maximum permissible openings of Table O-10; It shall, in itself, create no pinch point between the guard and moving parts of the machine; It shall utilize fasteners not readily removable by operator, so as to minimize the possibility of misuse or removal of essential parts; It shall facilitate its inspection, and it shall offer maximum visibility of the point of operation consistent with other requirements: On or about May 9, 2018, the guarding on the E.W. Bliss C-75 Ton press S/N H6969HP53033 Press #10 located in the main building did not have the fasteners installed on the point of operation barrier guards allowing them to easily be removed by the operator.
