29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) New apartment construction located at 2050 Cheshire Bridge Road, Roof on building 2000: On or about 05/09/2018, and at times prior, the employer exposed employees to fall hazards of 73-feet to the lower level, in that employees working on a 5/12 pitched roof installing roofing felt were not protected from falls to the lower level as fall protection systems were not connected to the anchor provided with the system and employees failed to connect lanyards to the D-ring on the full body harnesses being worn.

29 CFR 1926.503(a)(2)(ii): The employer did not assure that each employee, as necessary, had been trained by a competent person in the correct procedures for erecting, maintaining, disassembling and inspecting the fall protection systems to be used: (a) New apartment construction located at 2050 Cheshire Bridge Road, Roof on Building 2000: On or about 05/09/2018 and at times prior, the employer exposed employees to fall hazards of 73-feet, in that the employer failed to train employees correct procedures to erect, maintain and inspect personal fall protection systems. Anchors and life-lines were not used according to the manufacturer's specifications.
