OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees who are involved in the fitment process are exposed to struck-by hazards when using turn-buckles as bracing devices. (a) The employer did not ensure safe securement methods were utilized during the fitment process of internal baffle plates that are part of the truck body for a 7495 Electric Rope Shovel. Damaged turnbuckles were used, contrary to the manufacturers intent, to brace plates weighing over 1,500 pounds.
