29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. On May 7, 2018, there were no frequent and regular inspections being performed by a competent person in that employees were performing framing work at fall heights greater than 14 feet above the hard surface below without a fall protection system; one exposed employee (the Foreman) had tied a knot to attach one end of his rope to the front of his harness and tied another knot to attach to the tubular welded scaffold frame; another exposed employee had tied a rope hitch to attach the anchor end of his rope to a notched plywood sheet underneath the roof soffit; no ladder was provided for access and one employee was observed climbing down the frame of the tubular welded frame scaffold; at least one exposed employee did not receive scaffold training by a Competent Person; the tubular welded frame scaffold was not erected by a Competent Person; scaffold components manufactured by different manufacturers were intermixed and structural integrity was not maintained by the user (missing cross braces); the tubular welded frame scaffold working level platform was not fully planked; the tubular welded frame scaffold had several base plates being supported by concrete masonry units; and the tubular welded frame scaffold did not have guardrails at the working level platform.

29 CFR 1926.451(f)(7): Scaffolds shall be erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities shall be performed only by experienced and trained employees selected for such work by the competent person. On May 7, 2018, located on the east side of a commercial structure, employees were observed working from a tubular welded frame scaffold that had not been erected under the supervision and direction of a Competent Person. Potential fall heights were measured to be greater than 14 feet above the ground below.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part. On May 7, 2018, located on the east side of a commercial structure, employees were observed working from the upper level working platform of a tubular welded frame scaffold while not utilizing a fall protection system. Potential fall heights were measured to be greater than 14 feet above the ground below.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable: On May 7, 2018, employees were observed working from a tubular welded frame scaffold that had not received training to recognize the hazards associated with the type of scaffold being used, and to understand the procedures to control or minimize those hazards. Potential fall heights were measured to be greater than 14 feet above the hard surface below while not utilizing a fall protection system.
