29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2m) or more above a lower level was protected from falling by guardrail systems, safety net system, or personal fall arrest system:    (a)Western Consolidated Cooperative at 47229 US Highway 12, Twin Brooks, SD 57269: On or about and at times prior to April 16th, 2018, the employer did not ensure that employees were protected from fall hazards while accessing a platform constructed at the top of a scale hopper to perform preventative maintenance activities and housekeeping. An employee accessed the platform to clean the interior of the scale hopper. This condition exposed an employee to a fall hazard in excess of 17 feet while walking/working on the platform.

29 CFR 1910.219(c)(2)(i): All exposed parts of horizontal shafting seven (7) feet or less from floor or working platform were not protected by stationary casings enclosing shafting completely or by troughs enclosing sides and top or sides and bottom of shafting:    (a)Western Consolidated Cooperative at 47229 US Highway 12, Twin Brooks, SD 57269: On or about and at times prior to May 10, 2018, the employer did not ensure that a 1-inch in diameter, 60-inch driveshaft located underneath the USC LP2000 Model #2010, Serial #03112, Seed Treater was adequately guarded to ensure employees could not come into contact with the caught-by hazard presented by the rotating driveshaft. On May 10, 2018, an employee's hair became entangled around the driveshaft causing a portion of the scalp to be removed. This condition exposed an employee to caught-by hazards.
