29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level: a)Ace Sign Displays at 365 West Anchor Drive, Dakota Dunes, SD 57049: On or about and at times prior to May 10, 2018, the exposing employer did not ensure that employees were protected from falls when working on scaffolding with no fall protection when installing signage above the entrance of a commercial building under construction. This condition exposed both employees to falls of approximately 16 feet to concrete below. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.

29 CFR 1926.454(a): The employer did not ensure that each employee who performs work while on a scaffold was trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards: a)Ace Sign Displays at 365 West Anchor Drive, North Sioux City, SD 57049: On or about and at times prior to May 10, 2018, the exposing employer did not ensure that employees engaged in working from scaffolding were appropriately trained on fall hazard identification, recognition and methods to guard against falling.
