29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents: a) On or about May 14, 2018 and at times prior thereto at the work site; employees were using pneumatic nail guns without the use of safety glasses, exposing them to eye injuries from splintering wood or other material. The employer, ULTIMATE CONSTRUCTION ALBANY NY, LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.102(a)(1)), which was contained in OSHA inspection number 1065455, citation number 1, item number 1, and was affirmed as a final order on 9/3/2015, with respect to a workplace located at 109 Buckingham Drive, Albany, NY 12208.
