29 CFR 1926.1203(d): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 1926.1204 implemented at the construction site. The written program was not made available prior to and during entry operations for inspection by employees and their authorized representatives. Weymouth, MA- Waterfront near Stratford Street and Aspinwall Avenue: A written permit space program specific for curing in place pipe lining installations was not developed and implemented that described entry and rescue procedures for work conducted inside sewer pipes. The written permit space program 1) Did not identify sewer pipes as permit confined spaces to be entered by employees. 2) Did not identify potential styrene, a toxic air contaminant, and describe procedures for testing for styrene inside the cured pipe lining. 3) Did not identify emergency rescue procedures to remove an employee working inside a sewer pipe

29 CFR 1926.1204(e)(1): 29 CFR 1926.1204(e)(1): Permit confined space was not tested to determine if acceptable entry conditions existed before authorized entry was begun: Weymouth, MA- Waterfront near Stratford Street and Aspinwall Avenue: Testing for styrene, a potential air contaminant from the pipe liner curing process, was not conducted prior to entry and while work was conducted inside the cured sewer pipe liner.

29 CFR 1926.1203(e)(2)(ii): When entrance covers were removed the opening was not immediately guarded by a railing, temporary cover, or other temporary barrier that would prevent an accidental fall through the opening and that would protect each employee working in the space from foreign objects entering the space. Weymouth, MA-Waterfront near Stratford Street and Aspinwall Avenue: A manhole and vault opening approximately 12 feet deep, access ways to sewer pipe, were not guarded by railing to prevent workers on the ground from falling into the space.
