OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to impalement hazards from uncovered metal fence posts. On our about May 16, 2018, employees performing roofing activities were exposed to impalement hazards in the event of a fall due to uncovered metal fence posts installed into the ground below. Among other methods, feasible and acceptable means of hazard abatement include: (1) Removal of the temporary fence posts; (2) Relocate the temporary fence posts under the eve of the building; (3) Cover the tops of the temporary fence posts.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system: On or about May 16, 2018, employees were engaged in roofing activities on a low-slope roof and were exposed to falling nine feet to the ground below due to the lack of fall protection and or a monitoring system.
