29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer did not establish and implement a written respiratory protection program with worksite-specific procedures:  a) Gil's Masonry and Construction, LLC at 12433 104th Place, Commerce City, CO 80022: On or about 5/17/2018, the employer did not create and implement a written respiratory protection program in a workplace where respirators were necessary to protect the health of the employee. 1 employee was mixing Amerimix and Spec Mix mortar mix with water on site to be used in masonry operations; both mixes contain respirable silica, Portland cement, and lime. The employee was wearing a 3M N95 Particulate Respirator 8210 dust mask. This condition exposed employees to respiratory hazards.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met:  a)     Gil's Masonry and Construction, LLC at 12433 104th Place, Commerce City, CO 80022: On or about 5/17/2018, the employer did not develop, implement, and maintain at each workplace a written hazard communication program. 2 employees handle Amerimix mortar mix and Spec Mix mortar mix while mixing concrete by hand on site to be used in masonry operations. Both mortar mixes contain silica, Portland cement, and lime. This condition exposed employees to chemical and respiratory hazards.  Note: The requirements applicable to construction work under 1926.1153 are identical to those set forth in 29 CFR 1910.1200.

29 CFR 1910.1200(h)(1): The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area:  a) Gil's Masonry and Construction, LLC at 12433 104th Place, Commerce City, CO 80022: On or about 5/17/2018, the employer did not develop and train employees on a hazardous communication plan regarding hazardous chemicals at the work site. 2 employees handle Amerimix mortar mix and Spec Mix mortar mix while mixing concrete by hand on site to be used in masonry operations. Both mortar mixes contain silica, Portland cement, and lime. This condition exposed employees to chemical and respiratory hazards.  Note: The requirements applicable to construction work under 1926.1153 are identical to those set forth in 29 CFR 1910.1200.
