29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a) At 3213 Dauphin Street Mobile, Alabama (Intersections/Roadway & Driveway Areas):  On or about May 15, 2018, and at times prior thereto, the employer failed to instruct or train their employees in recognizing, eliminating or controlling hazards associated with work performed in an active roadway such as but not limited to flagger operations, thus exposing their employees to struck-by hazards from vehicular traffic.

29 CFR 1926.200(g)(1): The employer did not provide the requisite advance warning of construction work being conducted on the traveled way.  a) At 3213 Dauphin Street Mobile, Alabama (Intersections/Roadway & Driveway Areas):  On or about May 15, 2018, and at times prior thereto, the employer allowed their employees to perform excavations, driveway and curb constructions and the employer failed to provide advance warning to road users that road work (not short-duration or mobile) is taking place or what actions the road user must take to drive through the work zone, thus exposing their employees to struck-by hazards from vehicular traffic.

29 CFR 1926.200(g)(2): Traffic control signs or devices used for protection of construction workers did not conform to Part VI of the Manual of Uniform Traffic Control Devices (AMUTCD"), 1988 Edition, Revision 3, September 3, 1993, FHWA-SA-94-027 or Part VI of the Manual on Uniform Traffic Control Devices, Millenium Edition, December 2000, FHWA, in that the employer does not provide adequate channelizing devices to separate the traveled way from the work zone:   a) At 3213 Dauphin Street Mobile, Alabama (Intersections/Roadway & Driveway Areas):  On or about May 15, 2018, and at times prior thereto, the employer allowed their employees to perform excavations, driveway and curb constructions and the employer failed to place visible and conforming channelizing devices (i.e.: traffic cones) to demarcate the live traffic lane from the adjacent work zone, thereby exposing employees in the work zone to struck-by hazards from vehicular traffic.
