OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushed-by hazards when assisting in the loading of vehicles onto the runway (roll-on) type lifts in the service bays: (a) On or about May 19, 2018, in the vehicle service bay: the employer failed to assure an employee did not stand at the rear center (non-entry side) of a Rotary (model SM14N101Y) four post surface mounted vehicle lift to visually assist with vehicle positioning during loading in accordance with the employer's instructions for assisting with vehicle positioning during loading. Among other methods, the following are feasible means of abatement of the hazard: 1. Follow the safety instructions in the Rotary Lift SM14 Operation & Maintenance Manual including - "Be Sure no one is standing in front or behind lift while vehicle is being driven onto or backed off the lift."; 2. Follow the guidance on safe vehicle positioning in industry documents such as the Automotive Lift Institute (ALI) ALI/SM 10-1 ALI "Lifting it Right" safety manual (as referenced in the Rotary Lift SM14 Operation & Maintenance Manual) and the ALI "Automotive Lift Safety: Lifting it Right" interactive training course; and 3. Follow the American National Standards Institute (ALI) ANS/ALI ALOIM:2008 (R2013) "Standard for Automotive Lifts - Safety Requirements for Operation, Inspection, and Maintenance" which provides guidance in Section 4.2.1 for employers to provide employees operating lifts with instruction in the safe use and operation of the lift based on the manufacturer-provided instructions and warnings, the ANSI/ALI ALOIM standard, and ALI publications including ALI/SM 10-1 ALI "Lifting it Right".
