29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used:    (a)  On or about April 24th, 2018 and at times prior employees were exposed to a 14 foot fall hazard on a scaffold system without adequate means of access in the vicinity of 1601 University Drive North in Fargo, North Dakota.    Note: Mortenson Masonry was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1122647, citation number 1, item number 1 and was affirmed as a final order on 4/22/2016, with respect to a workplace located at Wahpeton High School, 1012 11th Street North in Wahpeton, North Dakota.

29 CFR 1926.451(g)(1):  Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level by fall protection established in accordance with paragraphs (g)(1)(i) through (vii) of this section:    (a)     On or about April 25th, 2018 and at times prior employees were exposed to an 18 foot fall hazard while performing brick laying operations in the vicinity of 1601 University Drive North in Fargo, North Dakota.    (b)     On or about April 25th, 2018 and at times prior an employee was exposed to a 12 foot fall hazard while transferring materials from one level to another in the vicinity of 1601 University Drive North in Fargo, North Dakota.  Note: Mortenson Masonry was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1122647, citation number 1, item number 2 and was affirmed as a final order on 4/29/2016, with respect to a workplace located at Wahpeton High School, 1012 11th Street North in Wahpeton, North Dakota.
