29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a. On or about May 22, 2018, located at 1444 North 6th Street, there was a 48 inch by 30 inch open floor hole near the back door on the first floor, thereby exposing the employees to a fall hazard of approximately seven feet one inch to the basement floor.   a. On or about May 22, 2018, located at 1444 North 6th Street, there was a 38 inch by 78 inch open floor hole near under the stairs to the second floor, thereby exposing the employees to a fall hazard of approximately seven feet one inch to the basement floor.

29 CFR 1926.1052(a)(3): Riser height and tread depth shall be uniform within each flight of stairs, including any foundation structure used as one or more treads of the stairs. Variations in riser height or tread depth shall not be over 1/4-inch (0.6 cm) in any stairway system.  a. On or about May 22, 2018, located at 1444 North 6th Street, there were stairs to the 2nd floor that were not uniform and required employees to skip a step when ascending and descending, thereby exposing the employees to a trip and fall down the stairs.

On or about May 22, 2018, located at 1444 North 6th street, there was no stairrail system on the open side of a stairway for employees ascending and descending the stairs, thereby exposing the employees to a fall hazard of approximately nine feet.
