29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a. On or about May 22, 2018 employees were working on the 2nd floor of the dwelling installing interior studs and fire blocking and were exposed to falls in excess of 10 feet to the ground below because the platform balcony was not equipped with guardrails.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stair rail system along each unprotected side or edge: a. On or about May 22, 2018 Employees working on the second floor of the residence were installing fire blocking and interior framed walls and were using the interior stairway system for access to and egress from the second floor. The Employees were exposed to falls in excess of 7 feet 6 inches to the floor level below.

29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill. Note: The following appendices to subpart M of this part serve as non-mandatory guidelines to assist employers in complying with the appropriate requirements of subpart M of this part. a). On or about May 22, 2018 one employee Mr. Ramon Rico, the Foreman on site was observed working on the roof of a new two story residential structure and was not protected from falling by any means of personal fall protection, guardrails or safety nets, exposing him to a fall in excess of 20 feet to the ground below.
