29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system: (a) Jobsite, 709 3rd Avenue, New Brighton, PA: On or about May 24, 2018 employees working a roof with a pitch of 3/12 were not protected from falling by guardrail systems, adequate personal fall arrest systems, or warning line system and safety monitor. Employees were exposed to fall hazards of approximately 18 feet to the ground below.

29 CFR 1926.503(c)(3):Retraining was not conducted by the employer when inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicated that the employee has not retained the requisite understanding or skill required by paragraph (a) of this section: Note: The following appendices to subpart M of this part serve as non-mandatory guidelines to assist employers in complying with the appropriate requirements of subpart M of this part. (a) Jobsite, 709 3rd Avenue, New Brighton, PA: On or about May 24, 2018 the employer had not retrained employees when inadequacies in the affected employee's knowledge or use of fall protection systems indicated they had not retained the understanding or skill to prevent falls. Employees were working at heights up to 18 feet and were wearing harnesses but did not tie off indicating they did not retain the understanding of the use of fall protection systems and procedures necessary to prevent falls.
