29 CFR 1910.269(g)(2)(iv)(C)(2): The employer did not ensure that each employee in elevated locations more than 1.2 meters (4 feet) above the ground on poles, towers, or similar structures used a personal fall arrest system, work-positioning equipment, or fall restraint system: (a)Hooper Corporation at 100 South Kiwanis Avenue, Sioux Falls, SD 57104: On or about and at times prior to May 24, 2018, the employer did not ensure an employee performing work at heights greater than four feet above the ground was protected from fall hazards. An employee's fall protection system was not attached to an anchorage while transitioning to a work area on the porch of a substation tower. This condition exposed one employee to a fall hazard of approximately 25 feet.

29 CFR 1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment were not independent of any anchorage being used to support or suspend platforms and/or were not capable of supporting at least 5,000 pounds (22.2 kN) per employee: (a)Hooper Corporation at 100 South Kiwanis Avenue, Sioux Falls, SD 57104: On or about and at times prior to May 24, 2018, the employer did not ensure employees performing work at heights greater than four feet above ground on a substation tower were protected from fall hazards. An employee utilized the interphase rod of a group operated outdoor vertical break air switch as an anchorage for part of their personal fall protection system. This exposed one employee to a fall hazard of approximately 25 feet. (b)Hooper Corporation at 100 South Kiwanis Avenue, Sioux Falls, SD 57104: On or about and at times prior to May 24, 2018, the employer did not ensure employees performing work at heights greater than four feet above ground level on a substation tower were protected from fall hazards in that an employee utilized the lower mounting bracket of a group operated outdoor vertical break air switch as an anchorage for part of their personal fall protection system. This exposed one employee to a fall hazard of approximately 25 feet. (c)Hooper Corporation at 100 South Kiwanis Avenue, Sioux Falls, SD 57104: On or about and at times prior to May 24, 2018, the employer did not ensure employees performing work at heights greater than four feet above ground level on a substation tower were protected from fall hazards in that, an employee utilized the upper portion of a group operated outdoor vertical break air switch as an anchorage for part of their personal fall protection system. This exposed one employee to a fall hazard of approximately 25 feet. Note: 29 CFR 1910.269(g)(2)(i) requires personal fall arrest systems to meet requirements set forth in Subpart M of Part 1926.
