29 CFR 1910.23(d)(13)(ii): (ii) A minimum perpendicular distance of 30 inches (76 cm) was not provided from the centerline of the steps or rungs to the nearest object on the climbing side. When unavoidable obstructions were encountered, the minimum clearance to the obstruction may be reduced to 24 inches (61 cm), provided deflector plates are installed: Employees engaged in grain handling operations entering and exiting the tunnel areas were exposed to struck by hazards in that the ladder utilized to access the tunnels was not provided with adequate clearance as required.

29 CFR 1910.30(a)(3)(iv): The correct use of personal fall protection systems and equipment specified in paragraph (a)(1) of this section, including, but not limited to, proper hook-up, anchoring, and tie-off techniques, and methods of equipment inspection and storage, as specified by the manufacturer. The Employer failed to train each employee in the correct use of personal fall protection systems as evidenced when employees engaged in maintenance activities in the top of the head house without personal fall protection systems and were therefore exposed to fall hazards.
