29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a): Exterior- Portable ladders used for access by employees to an upper landing surface did not have the ladder rails extend at least 3 feet above the upper landing surface. Five employees were accessing a residential roof by using a portable ladder that did not have rails extend at least 3 feet above the upper landing surface, on or about May 23, 2018. There is no abatement certification or documentation required for this item.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a). Exterior- Employees engaged in residential construction 6 feet or more above lower levels were not protected by any method of fall protection. Five employees were exposed to fall hazards of approximately 10 feet while working on the roof, on or about May 23, 2018. There is no abatement certification or documentation required for this item. Falcony Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1176678, citation number 1, item number 2, and was affirmed as a final order on 12/13/2016, with respect to a workplace located at 153 Princeton Ave Morris New Jersey 07801
