29 CFR 1910.95(i)(5): The employer did not ensure proper initial fitting and supervise the correct use of all hearing protectors:  On or about July 24, 2018, at 3780 West 104th ST. Hialeah, FL 33018 windows department, an employee operating a cutting saw was exposed to a noise level of 90.7dBA, which exceeds the action level of 83.4dBA, during the 10-hr representative sampling period. The employer failed to ensure the trainee working alongside this employee was wearing hearing protection properly.

29 CFR 1910.101(b): The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tankcars, or motor vehicle cargo tanks were not in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in CFR 1910.6:   a) On or about May 23, 2018, at the 3780 West 104th St. Hialeah, FL 33018 welding department, three (3) argon cylinders were stored and not secured, creating a struck-by hazard to the employees.   b) On or about May 23, 2018, at the 3780 West 104th St. Hialeah, FL 33018 maintenance department, an argon cylinder was stored and not secured, creating a struck-by hazard to the employees.  c) On or about May 22, 2018, at the 3780 West 104th St. Hialeah, FL 33018 maintenance department, an acetylene and oxygen cylinder were stored and not secured, creating a struck-by hazard to the employees.

29 CFR 1910.252(c)(1)(iv): The employer did not include the potentially hazardous materials employed in fluxes, coatings, coverings, and filler metals, all of which are potentially used in welding and cutting, in the program established to comply with Hazard Communication Standard (HCS) (sec. 1910.1200).  On or about May 22, 2018, at the 3780 West 104th St. Hialeah, FL 33018 facility, employees were not trained nor did they know where to access the safety data sheets for materials used during welding operations.
