Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.451(e)(5)(i): Ramps and walkways 6 feet (1.8 m) or more above lower levels did not have guardrail systems that comply with subpart M of this part -- Fall Protection:    a) Worksite, 10 Captains Neck Ln, Southampton, NY - An employee was accessing the roof of a residential home  by walking across a walkway from the fourth tier of a fabricated frame scaffold approximately 27 feet above the ground below without a guardrail system; on or about 05/25/2018.     b) Worksite, 10 Captains Neck Ln, Southampton, NY - An employee was accessing the fabricated frame scaffold by walking across a walkway from the second story window sill approximately 15 feet above the ground below without a guardrail system; on or about 05/25/2018.    Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.451(g)(4)(xv): Crossbracing used in place of a midrail was unacceptable because the crossing point of two braces is between 20 inches (0.5 m) and 30 inches ((0.8 M) above the work platform or as a toprail when the crossing point of two braces is not between 20 inches (0.5 m) and 30 inches (0.8 m) above the work platform or as a toprail when the crossing point of two braces is between 38 inches (0.97 m) and 48 inches (1.3 m) above the work platform.  The endpoints at each upright were more than 48 inches (1.3 m) apart.    a) Worksite, roof on the south side of residential building - An employee was working from the fourth tier of a fabricated frame scaffold approximately 27 feet above the ground below without  a midrail, on or about 5/25/2018.     Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
