1926.102(a)(1): Employees were not provided with eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:    On or about May 30, 2018, and at times prior thereto, two employees were not protected by eye or face protection while using an DeWalt Masonry Saw to cut pieces of Acme Brick, exposing the employees to the hazard of being struck by flying debris.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used:    On or about May 30, 2018, and at times prior thereto, employees were using the cross braces and scaffolding frame to gain access to the scaffolding, exposing employees to a fall hazard of approximately 14 feet.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level:   On or about May 30, 2018, and at times prior thereto, one employees was operating a pressure washer on top of the second tier of the two tier scaffolding system and was not protected by a guardrail system, exposing the employee to a fall hazard of approximately 14 feet.

29 CFR 1926.454(b)(2): The correct procedures for erecting, disassembling, moving, operating, repairing, inspecting, and maintaining the type of scaffold in question were not followed.    On or about May 30, 2018, and at times prior thereto, employees were working on the two tier scaffolding erected next to the commercial property under construction, the scaffolding system had multiple deficiencies, such as: missing ladders and no guard rails on the second tier.

29 CFR 1926.1153(d)(2)(i): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section:    On or about May 30, 2018, and at times prior thereto, the employer did not assess employee exposures to respirable crystalline silica during masonry work, such as cutting red bricks. Respiratory protection was not provided and engineering controls were not in place.
