29 CFR 1910.146(c)(5)(ii)(C): Before an employee enters the space, the internal atmosphere shall be tested, with a calibrated direct-reading instrument, for oxygen content, for flammable gases and vapors, and for potential toxic air contaminants, in that order. Any employee who enters the space, or that employee's authorized representative, was not be provided an opportunity to observe the pre-entry testing required by this paragraph. (a) Location - Magic Box or Cassette space: On or about 4/30/18, the employer did not enter actual atmospheric values so they could be observed by employees before entering the confined space.

29 CFR 1910.146(k)(1)(ii): An employer who designates rescue and emergency services, pursuant to paragraph (d)(9) of this section, did not evaluate a prospective rescue service's ability, in terms of proficiency with rescue-related tasks and equipment, to function appropriately while rescuing entrants from the particular permit space or types of permit spaces identified. (a) Location - Rotor Concentrator Wheel Space: On or about 5/1/18, the employer failed to evaluate a rescue services ability to respond and rescue entrants should the need arise.
