29 CFR 1910.29(b)(1): (1) The top edge height of top rails, or equivalent guardrail system members, are 42 inches (107 cm), plus or minus 3 inches (8 cm), above the walking-working surface.  The top edge height may exceed 45 inches (114 cm), provided the guardrail system meets all other criteria of paragraph (b) of this section (see Figure D-11).  a. In the warehouse, the top edge of the top rails on the mixer platform were not at the required heights of at least 42 inches, plus or minus 3 inches.

Covers and/or guard- rails shall be provided to protect personnel from the hazards of open pits, tanks, vats, ditches, etc. [39 FR 23052, June 27, 1974, as amended at 43 FR 49749, Oct. 24, 1978]  a. In the warehouse, the employer did not ensure there was a cover, guard, or adequate guardrail system in place to protect employees from falling into the open tank of the mixer when adding ingredients to the mixer tank.

29 CFR 1910.134(c)(2)(ii): In addition, the employer must establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily is medically able to use that respirator, and that the respirator is cleaned, stored, and maintained so that its use does not present a health hazard to the user. Exception: Employers are not required to include in a written respiratory protection program those employees whose only use of respirators involves the voluntary use of filtering facepieces (dust masks).  a.
