29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a power industrial truck (PIT) and as referenced by the note contained in 1926.602(d):  a. At the jobsite, on or about June 1, 2018, a PIT operator and approximately 90 framing employees were exposed to struck-by and crushed-by hazards when they operated, or worked in close proximity to, a JBC 510-56F telescopic handler, serial number 1828; without the required operator training and evaluation for that PIT.

29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary:  a. On or about, May 25, 2018, at the north wall of Unit 1217 in Building 1000, the two platform planks of a job made carpenter's bracket scaffold were spaced with a range of 1-inch on the right side of the scaffold to 6 1/4-inch on the left side of the scaffold and exposed two employees to tripping and caught-in hazards.

On or about, May 25, 2018, at the north wall of Building 1000, Unit 1217, two employees used a carpenter's bracket scaffold that was not inspected by a competent person, had visible defects and exposed two employees to tripping and caught-in hazards.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  a. On or about May 25, 2018, within Unit 1217 of Building 1000, an employee who worked from an unprotected carpenter's bracket scaffold, fell 18-foot, 6-inch to the lower level and was injured.  Cabron Framing, LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 1926.501(b)(13), which was contained in OSHA inspection number 1291292, citation number 1, item number 1 and was affirmed as a final order on May 16, 2018, with respect to a workplace located at 7399 Amelia Island Parkway, Fernandina Beach, Florida 32034.
