OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushed-by hazards:     a) Morning Call Press Room, Allentown PA - On or about May 29, 2018, Employees moving a Goss Metroliner newspaper press used swivel bolts that were not correctly rated, sized, and torqued, to suspend the press from a crane.    Among other means, feasible abatement would include, but not be limited to:  1) Comply with all provisions of ASME B30.26-2015, Rigging Hardware, Safety Standard for Cableways, Cranes, Derricks, Hoists, Hooks, Jacks, and Slings, Chapter 26-2.  2) Ensure all employees have been trained in all provisions required by ASME B30.26-2015, Rigging Hardware, Chapter 26-2, Section 26-2.7.  3) Develop and implement procedures to ensure employees have all necessary information, documentation, tools, and equipment to fully comply with the provisions of ASME B30.26-2015, Rigging Hardware, Chapter 26-2, Section 26-2.9 Operating Practices, including but not limited to Paragraph 26-2.9.1 - Adjustable Hardware Selection, and 26-2.9.4 - Rigging Practices.  4) Develop and implement procedures and documentation to ensure equipment needs are fully evaluated, inventory is checked prior to commencement of the job, all necessary manufacturer documentation is available, and equipment is stored in a clean and orderly manner to facilitate proper selection and inspection for serviceability.

29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: (A) Guardrail systems; (B) Safety net systems; or (C) Personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems:  a) Morning Call press room, 2nd floor - On or about May 29, 2018, employees walked and worked in close proximity to an unprotected edge where an overhead door was kept open, exposing them to a fall hazard greater than 10 feet that could cause serious injury.

The maximum angular exposure of the grinding wheel periphery and sides for safety guards used on other portable grinding machines shall not exceed 180 deg. and the top half of the wheel shall be enclosed at all times.    a) Morning Call press room - On  or about May 29, 2018, Employees used portable hand held DeWalt angle grinders with the guards removed during press removal operations.
