29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): On or about May 30, employees were waterproofing the Taco Bell under construction using a rough terrain forklift and a man basket without the operator being trained and certified, exposing employees to a fall hazard.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1m) above a lower level was not protected from falling to that lower level by fall protection established in accordance with paragraphs (g)(1)(i) through (vii) of this section: On or about May 30, employees were waterproofing the Taco Bell under construction using a rough terrain forklift with a man basket attachment approximately 19 feet high without a safety harness, exposing employees to a fall hazard.
